TERMS & CONDITIONS

INTERNATIONAL RETREATS

These Terms and Conditions (hereinafter referred to as the “Agreement”) are entered into between Mothers Moving Mountains, LLC (“MMM”), a limited liability company registered in the State of Colorado, and the participant (hereinafter referred to as the “Participant”), who wishes to enroll in an international retreat organized and led by MMM.
By paying a deposit or signing this Agreement, the Participant accepts and agrees to be bound by the terms and conditions outlined herein.

RESERVATIONS AND ACCEPTANCE OF BOOKING
Participants can reserve space on an MMM international retreat through online booking, email communication, or by phone. The Participant’s booking will be considered accepted, and a contract for services will be established between the Participant and MMM only upon receipt of written confirmation from MMM. MMM retains the right to treat any reservation that does not comply with the reservation and payment terms as a cancellation, subject to the cancellation terms detailed below.

DEPOSITS AND FINAL PAYMENT
The Retreat’s overall cost is detailed on the MMM website and is subject to variation depending on the specific retreat. Each Retreat fee (“Fee”) comprises a non-refundable deposit of [Insert deposit amount], which is due upon booking, and the outstanding balance, which must be paid in full no later than 60 days before the start of the Retreat. When the Participant makes the non-refundable deposit, they are expressly agreeing to these Terms & Conditions, including any reasonable amendments that MMM, at its sole discretion, may introduce.

LAST MINUTE BOOKINGS
For individuals considering participation in a retreat with a departure date scheduled within the next 60 days or less, it is important to note that full payment for the entire retreat will be required immediately upon the acceptance of their booking. This expedited payment is essential to facilitate timely logistical arrangements and secure accommodations, ensuring a smooth and enjoyable retreat experience.

CANCELLATION BY PARTICIPANT
For cancellations received more than 90 days prior to the commencement of the Retreat, MMM will process a refund equivalent to the total amount paid, minus the non-refundable deposit of $500.00
Cancellation requests received more than 60 days but less than 90 days prior to the Retreat Commencement will be eligible for a partial refund, equating to 50% of the total amount paid, minus the non-refundable deposit.
No refunds will be issued for cancellations made within 60 days or less leading up to the Retreat Commencement. However, in the case of extenuating circumstances, refund requests will be assessed on a case-by-case basis, and the refund amount, if any, will be determined accordingly.
MMM CANCELLATION AND TERMINATION POLICY
MMM retains the right to cancel the Retreat at any time leading up to the Retreat Commencement, and this decision may be based on various factors.
In the event of a cancellation by MMM, the Participant will be promptly refunded the full Retreat Fee. However, it is essential to recognize that MMM will not assume liability for any additional costs or expenses incurred by the Participant in connection with the Retreat.
MMM may, at its sole discretion, terminate a participant’s involvement in the Retreat, either before or during the Retreat, should the participant breach these terms or any other rules and regulations established by MMM and its partners both locally and internationally. In cases of termination due to a breach, the Participant shall not be entitled to any form of refund.

MODIFICATIONS AND ALTERATIONS
Should a Participant wish to make changes to their retreat selection or modify their itinerary subsequent to booking confirmation, MMM will strive to accommodate these requests to the best of its ability.
In the event that such changes can be facilitated, a minimum change fee of no less than $50 will apply, although the fee may vary depending on the nature and extent of the requested alterations.
External suppliers, including hotels, may impose additional charges or penalties related to modifications and cancellations, and these additional fees will be incorporated into the change fee. All change requests must be submitted in writing.

CHANGES AFTER RETREAT COMMENCEMENT
Any requests for alterations that arise after the commencement of the Retreat will be forwarded to our independent suppliers. While MMM will make diligent efforts to accommodate reasonable requests, we cannot guarantee that changes will be feasible once the Retreat has started. It is essential to acknowledge that changes made after departure can be highly disruptive.
In the event of a change request or if a Participant chooses to abstain from scheduled activities during the Retreat, the Participant will be responsible for any cancellation fees, change charges, or associated costs linked to the modifications. No refunds will be issued to Participants who do not complete the Retreat or miss scheduled activities, regardless of the reason, including illness or injury.
Furthermore, if a Participant falls ill or sustains an injury during the Retreat, leading to their absence from subsequent activities or an early departure, MMM shall not issue refunds for the remaining trip costs.

FORCE MAJEURE
Mothers Moving Mountains, LLC (MMM) is not liable for any failure to perform its obligations under this agreement due to events beyond its reasonable control, such as acts of God, war, terrorism, strikes, pandemics, or other unforeseen circumstances.
If such an event occurs, MMM will use reasonable efforts to reschedule the retreat or provide a refund to participants, at MMM’s sole discretion.
In the event of a force majeure event, MMM reserves the right to cancel the retreat at any time, even after the retreat has begun. If MMM cancels the retreat, participants will be entitled to a full refund of their retreat fees, minus any non-refundable expenses that MMM has already incurred.
MMM also reserves the right to modify the itinerary of the retreat in the event of a force majeure event. If MMM modifies the itinerary, participants will be notified as soon as possible.
Participants agree that they will not hold MMM liable for any losses or damages incurred as a result of a force majeure event.

MMM RETREAT CANCELLATIONS OR ALTERATIONS AND FLEXIBILITY
MMM maintains the prerogative to cancel, amend, or adjust any Retreat without prior notification, primarily for the welfare and comfort of its clients and in response to Force Majeure circumstances.
Participants must recognize that the amenities, accommodations, transportation, route, schedule, and itinerary may undergo modifications without advance notice due to local factors or unforeseen events, which may encompass mechanical failures, flight disruptions, labor disputes, adverse weather conditions, border crossing difficulties, and other unforeseeable variables. In the unlikely event of a substantial change initiated by a supplier (e.g., bankruptcy) prior to departure, MMM will promptly inform you of available alternative options.
Any such modifications may necessitate additional payments from the Participant or result in a refund, minus applicable cancellation fees and non-refundable deposits. In cases of MMM-initiated cancellations (a rare occurrence), a full refund will be issued to the Participant, deducting any airline ticket cancellation fees incurred by MMM if reserved for Participants, non-refundable deposits extended to local suppliers, and any third-party cancellation costs. This refund will serve as a comprehensive resolution for any claims arising from our cancellation. Please note that no refunds under this provision will be granted for cancellations or changes attributable to Force Majeure.

PRICE ADJUSTMENTS
MMM determines quoted Retreat prices well in advance of departure, factoring in projections for fuel costs, exchange rates, inflation, tariffs, government fees, airfares, and other expenditures based on available information. Under standard conditions, the price at booking remains guaranteed.
In rare circumstances where prevailing costs create an untenable financial situation if absorbed entirely by MMM, we reserve the right to pass on these unforeseen expenses, either in whole or in part, to the Participant.
In the event of such an adjustment and if the Retreat price escalates by more than 10% of the original Retreat cost, excluding insurance premiums, the Participant may opt to cancel the booking within a 10-day notice of the surcharge and receive a full refund, excluding non-refundable deposits paid to our suppliers. MMM collaborates with our suppliers to attempt to retrieve any non-refundable deposits, although we cannot assure this outcome. The participant will be provided with advance written notice of any price increase, along with an explanation for the adjustment.

POST-BOOKING CHARGES
In the event that MMM incurs excess expenses after the retreat has commenced due to unforeseen circumstances, schedule changes, or other variables, MMM reserves the right to keep Participants’ credit card information securely stored in the payment platform and charge them for any additional charges. By signing this agreement, Participants authorize MMM to charge their stored payment method without prior notice. However, Participants will be notified in advance of the nature and amount of any such charges. This includes but is not limited to change fees, price adjustments, or supplementary payments that may arise during the course of the retreat.
Participants hereby grant MMM authorization to charge their credit card for any incurred change fees, price adjustments, or supplementary payments following the initial booking. If an alternative payment method is preferred, participants must provide written notification at the time of booking.
Participants acknowledge and agree that any credit card information provided for this purpose will be kept confidential and securely stored by MMM in compliance with all applicable data protection regulations. MMM shall exercise due diligence to maintain the confidentiality and security of such information.
Participants further acknowledge that they are solely responsible for ensuring the accuracy and validity of the credit card information provided. In the event of any disputes, discrepancies, or unauthorized charges, participants agree to promptly notify MMM to rectify the issue. MMM shall not be held liable for any errors, omissions, or unauthorized transactions related to the use of the provided credit card information.

NON-REFUNDABLE PERSONAL EXPENSES
Participants should be aware that they will not be reimbursed for any personal expenses, such as airfare, hotel reservations, or other travel-related costs, resulting from alterations to itineraries or Retreat cancellations.

LUGGAGE RESPONSIBILITY
Mothers Moving Mountains, LLC (MMM) is not responsible for lost, damaged, or stolen luggage. Participants are responsible for their own luggage at all times, both during and outside of retreat hours. MMM recommends that participants purchase travel insurance to protect their luggage in case of loss, damage, or theft.

SUPPLIER SELECTION AND RESPONSIBILITY:
MMM exercises reasonable care in the selection of competent, dependable, and qualified Suppliers based on information reasonably accessible to them. However, it is essential to understand that MMM exclusively serves as an intermediary for various independent suppliers who furnish lodging, meals, transportation, sightseeing, activities, and other goods and services associated with the Retreat (“Supplier” or “Suppliers”).
The Participant hereby acknowledges their awareness and clear understanding that these Suppliers function as independent contractors, are not under MMM management, and do not act as MMM’s agents or employees.
MMM assumes no responsibility for the actions or inactions of their Suppliers, and they are not accountable for (nor will they provide a refund for) any delay, cancellation, overbooking, or labor strike initiated by a Supplier.

INSURANCE
All participants must have travel insurance that covers the following:
Medical expenses, including hospitalization, emergency care, and repatriation of remains
Lost, damaged, or stolen luggage
Retreat cancellation and interruption
Missed connections
Travel delays
Personal liability
Adventure sports (if applicable)
Participants should purchase travel insurance from a reputable company and should make sure that the policy they purchase meets their specific needs. MMM recommends that Participants review their travel insurance policy carefully before the retreat to make sure that they understand the coverage it provides.
MMM reserves the right to cancel a participant’s registration if they do not have adequate travel insurance.

ACTIVITY INCLUSIONS
Participant acknowledges and agrees that the retreat activities and the aforementioned ‘Adventure sports’ may include, but are not limited to: hiking, trekking, mountaineering, backpacking, mountain biking, road biking, kayaking, and swimming. Participant understands that engaging in these activities involves inherent risks, and by participating, they voluntarily assume all risks associated with such activities, including but not limited to personal injury, property damage, or other harm. Participant further acknowledges and agrees that MMM shall not be liable for any injuries or damages arising out of or related to their participation in the specified activities during the retreat.

PRE-DEPARTURE DOCUMENTATION: PASSPORTS, VISAS, AND TRAVEL DOCUMENTS
Participants are responsible for ensuring that they have all the required pre-departure documentation, including:
A valid passport with at least six months of validity remaining after the return date of the retreat.
Any necessary visas.
Proof of travel insurance.
Any required vaccinations or medical certificates.
Any other documentation mandated by the destination country.
Participants are encouraged to consult the embassy or consulate of the destination country to ascertain specific pre-departure documentation requirements. MMM shall not be held accountable for any issues arising due to the absence of required pre-departure documentation. To avoid any last-minute hassles, MMM suggests Participants review their passport and visa status thoroughly before booking the Retreat.
MMM further recommends that Participants make copies of all their travel documents and entrust them to a trusted friend or family member before the Retreat. This precaution will facilitate access to vital travel documents in the event of loss or theft.
Additionally, Participants should verify any specific pre-departure documentation requirements with their chosen airline or other travel providers. For example, certain airlines may necessitate online check-in or advance boarding pass printing.
MMM may provide information or advice regarding matters like visas, vaccinations, climate, clothing, baggage, and specialized equipment as a courtesy to participants. Nevertheless, MMM disclaims responsibility for any inaccuracies or omissions in the provided information. Participants are accountable for any adverse consequences resulting from incomplete or defective documentation.

FLIGHTS AND AIRLINE CHANGES
Mothers Moving Mountains, LLC (MMM) may offer to assist participants with flight reservations for certain itineraries and under certain conditions. However, MMM takes no responsibility for reconfirming flights or for advising Participants of airline schedule changes once tickets have been issued.
MMM shall collaborate with a qualified travel agency for the booking of airline reservations, particularly one capable of providing assistance in the event of disrupted flight schedules.
Furthermore, the establishment of an on-the-ground point of contact in the United States and in the destination, dedicated to assisting with significant issues, shall be undertaken to enhance the overall travel experience and address any unforeseen challenges that may arise during the Participants’ journeys.
MMM recommends that participants purchase travel insurance that covers airline default. Travel insurance can also provide coverage for other unexpected events, such as trip cancellation and interruption, missed connections, and travel delays.
Additionally, MMM takes no responsibility in the event of an airline’s default, cessation of service on a ticketed route, or schedule change.
MMM is not responsible for any losses or damages incurred by Participants as a result of airline default, cessation of service on a ticketed route, or schedule change.

MEDICAL REQUIREMENTS
Participants must be in good health and able to participate in the activities of the Retreat. Participants must disclose any medical conditions or limitations in writing to MMM prior to booking their Retreat.
MMM is not a medical provider and does not provide medical care. In the event of a medical emergency, MMM will assist Participants in obtaining medical care. However, Participants are responsible for all costs associated with medical care.
MMM recommends that participants purchase travel insurance that covers medical expenses.
MMM reserves the right to cancel a Participant’s registration if the participant has a medical condition that would make it unsafe for them to participate in the retreat.
MMM is not responsible for any health conditions that Participants may experience during or after the Retreat. Participants are responsible for their own health and well-being.

RIGHT TO DENY PARTICIPATION
MMM reserves the right to deny participation in the Retreat to any Participant at any time before or during the Retreat, at MMM’s sole discretion.
MMM may deny participation for the following reasons:
The Participant lacks the physical or mental capacity to meet the demands and prerequisites of the Retreat activities.
The Participant’s actions or deportment are unsuitable for group travel.
The Participant is a threat to the safety of themselves or others.
The Participant is in violation of MMM’s terms and conditions.
20.3. If MMM denies participation in the Retreat to a Participant before the Retreat commencement, the Participant will be responsible for all costs resulting from the denial, including transportation costs, accommodation costs, and any other applicable costs. In such cases, the Participant shall be eligible for a refund of their retreat cost, minus the nonrefundable deposit and any fees or costs resulting from the denial.
20.4. Should MMM decide to refuse participation on the grounds of physical or mental incapacity, or a participant sustains an injury immediately prior to the Retreat, the participant may be entitled to a refund for any costs that align with the Retreat’s refund policies. However, it is important to note that this refund will be issued after deducting the deposit, taking into account the prevailing circumstances, and any expenses that MMM has incurred and cannot recover.

COMPLAINTS
If the Participant has a complaint during the Retreat, they must notify the Retreat leader so that they can attempt to solve it. If the Participant is not satisfied with the response from the retreat leader, they may submit a written complaint to MMM’s management team within 30 days of the Retreat’s end date. MMM’s management team will investigate the complaint and respond to the Participant within 14 business days. All costs associated with the complaint procedure rest entirely on the Participant.

RETREAT DEPARTURE DATE
Participants are responsible for being ready to embark on the Retreat on the date and time specified in the itinerary. MMM is not responsible for any losses incurred by Participants who are late or miss their flights, trains, or other transportation arrangements. Participants are also responsible for any additional costs associated with late arrivals or early departures, such as hotel accommodations or transportation fees.

RETREAT CONDUCT AND ETIQUETTE
Participants in MMM Retreats are expected to comply with all local laws and regulations, as well as respect local customs and culture. Participants must also accurately assess their physical abilities and limitations, and respect the privacy and safety of other Retreat Participants. For their safety, Participants are required to follow the instructions and advice of MMM retreat leaders at all times.
MMM reserves the right to remove any participant from the Retreat at any time, at MMM’s sole discretion, for any reason that MMM deems to be in the best interests of the safety and well-being of the other participants or the retreat as a whole. Participants who are removed from the Retreat will be responsible for all costs associated with their early departure, including transportation and accommodation costs.
Participants should refer to MMM’s Code of Conduct in Schedule 1 to understand unacceptable conduct during the Retreat.

IMAGES
By participating in the Retreat, the Participant grants MMM a royalty-free, non-exclusive, worldwide license to use, reproduce, modify, distribute, and display any images, photos, or videos of you, individually or in a group, that are taken by MMM guides or other participants during the retreat. This license includes the right to use the images for any purpose, including promoting and publicizing MMM travel products and services worldwide. The Participant may revoke this license at any time by contacting MMM in writing. Additionally, participants have the option to opt in or out of this image and video use agreement by notifying MMM in writing.

LIMITATION OF LIABILITY
The Participant acknowledges that participation in the retreat may involve certain inherent risks and dangers, including but not limited to travel-related risks, service-related risks, and external risks such as natural disasters, terrorism, and personal attacks.
MMM is not liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected to participation in an MMM Retreat, including but not limited to:
Lost profits
Personal injury
Property damage
Emotional distress
Punitive damages
MMM’s liability is expressly limited to instances of negligence and breach of contract. This limitation applies without exception, regardless of the cause of damages, and shall remain in force even if MMM has been made aware of the potential for such damages.
Participants expressly agree to assume all risks associated with their participation in the Retreat, including the risk of injury, death, and property damage. Participants also agree to waive any claims they may have against MMM for any damages arising out of or in any way connected to their participation in the Retreat.
Participants agree that they will not sue MMM for any damages arising out of or in any way connected to their participation in the Retreat. This waiver of the right to sue applies to all claims, including but not limited to claims for personal injury, property damage, and emotional distress.
Participants are required to sign a Liability Waiver before participating in the Retreat. The Liability Waiver provides more detailed information about the risks associated with participation in the retreat and the participant’s agreement to assume those risks.

SEVERABILITY
If any provision of this agreement is held to be invalid or unenforceable, such provision will be struck from the agreement and the remaining provisions will remain in full force and effect.

SUCCESSORS AND ASSIGNS
This Agreement shall bind and benefit MMM and the Participant, and their respective heirs, legal and personal representatives, successors, and assigns.

AMENDMENTS
Mothers Moving Mountains, LLC (MMM) may, at any time, make changes to these terms and conditions at its sole discretion. Any changes will take effect seven days after being posted on MMM’s website, or immediately upon written notice to the Participant by email. The Participant may request a copy of the most up-to-date terms and conditions at any time. They are deemed to have accepted any changes to these terms and conditions on the date that is seven days after they are posted on MMM’s website. MMM recommends that the Participant review these terms and conditions before traveling to familiarize themselves with the most current version.

MERGER
This agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.

APPLICABLE LAW
This Agreement shall be governed by and construed in accordance with the laws of Colorado, U.S.A. and any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Colorado, U.S.A.

ACKNOWLEDGMENT
The Participant has read and understands that these Terms and Conditions are legally binding; and voluntarily accepts this whole document in its entirety.

 

SCHEDULE 1
Code of Conduct
International Retreat Substance Use Policy

At MMM, our mission is to create a safe, enjoyable, and sacred space where Participants can foster conscious and mature experiences. Our international retreat is designed for personal growth and self-discovery, and as such, we emphasize responsible and respectful behavior. This policy outlines our stance on the use of mind-altering substances during the retreat.

Alcohol: Alcohol may be served in the evenings after dinner and should be consumed responsibly by all Retreat Participants in accordance with the Code of Conduct unless prohibited by the local laws of the destination country
Cannabis: The use of medical cannabis is permitted, unless it is prohibited by the laws of the destination country. In destinations where recreational edible cannabis is legally available and a group consensus has been reached, it may be used in the evenings when other Participants are engaging in alcohol consumption. Smoking cannabis and/or tobacco is prohibited on the Retreat property. Participants are expected to use both alcohol and cannabis responsibly and refrain from using these substances to unnecessarily alter their states of consciousness during the Retreat.
Plant Medicine: The use of plant medicine, including but not limited to substances such as ayahuasca, psilocybin, peyote, huachuma, and any other similar medicinal agents, is strictly prohibited. The inclusion of cacao ceremonies in the Retreat program shall be contingent upon their public availability at the Retreat location. Participants retain the right to provide their informed consent for engagement in these ceremonies and possess the option to abstain from any activities during the Retreat at their discretion.
Tobacco: Smoking tobacco is strictly prohibited on the Retreat property and all areas that the destination country might deem inappropriate.
Legal Compliance: Please be aware that our policy may vary depending on the destination country’s laws and regulations. It is your responsibility to adhere to the local laws and regulations of the countries we visit regarding substance use.
MMM reserves the right to remove alcohol or cannabis from the location and enforce the code of conduct should it be violated as a result of consumption.

General
MMM is committed to providing a positive and trouble-free experience for all, regardless of gender, gender identity and expression, sexual orientation, disability, physical appearance, body size, race, ethnicity, age, theological perspective, or relationship status. We do not tolerate unacceptable behavior in any form. Any participant violating these rules or engaging in a behavior that is disruptive to MMM, the other participants, or the property where the Retreat is being held, as determined in MMM’s sole and absolute discretion, will be asked to leave immediately with no refund.

Unacceptable behavior includes but is not limited to the following:
Verbal harassment, including but not limited to when it reinforces social structures of domination related to gender, gender identity, and expression, sexual orientation, disability, physical appearance, body size, race, age, theological perspective, or relationship status.
Verbal harassment or collusion regarding others’ opinions, communications styles, or personalities.
Offensive, profane, or abusive language.
Deliberate intimidation, bullying, and/or stalking, or any other behavior likely to cause alarm or distress to a reasonable person.
Photography or recording without written or verbal consent.
Sustained disruption of talks or other activities (including thorough intoxication of alcohol and/or drugs).
Intentional and sustained noise disruption during quiet hours.
Possession, distribution, or use of cigarettes, illegal drugs, drug paraphernalia, chewing tobacco, fireworks, pornographic material, and weapons.
Inappropriate or unwanted physical contact; always seek consent when initiating any physical contact with another person.
Unwelcome sexual or other personal attention.
Theft or extortion, including deception. Missing/Damaged Items. Upon departure, if there is any damage to or items missing from the room, participants will be responsible for the cost of repair, replacement, and/or cleaning.
In the event that a participant engages in vandalism or willful misconduct leading to damage or destruction of the property or belongings of the property owner where the Retreat is hosted, the participant shall bear full responsibility for all resulting damages. The participant shall reimburse MMM for all costs and expenses incurred by MMM due to such misconduct. If such incidents occur within a city, in a natural setting, or pertain to property outside of the retreat site or accommodations, the participant shall remain subject to the same obligations, including financial liability for any damages, as detailed in this clause.
Advocating for, or encouraging, any of the above behavior.

Enforcement:
If anyone is asked to cease unacceptable behavior, it is expected that they will comply immediately. MMM will take any actions reasonably necessary to maintain a welcoming environment for all participants. This may include warning the person who is acting in breach of this policy and, in appropriate cases, requiring them to leave the Retreat without a refund.

INTERNATIONAL RETREAT LIABILITY WAIVER CONTRACT
This International Retreat Liability Waiver Contract (hereinafter referred to as the “Contract”) is entered into between the undersigned participant, whose details are provided below (hereinafter referred to as the “Participant”), and Mothers Moving Mountains, LLC (“MMM”), a limited liability company registered in Colorado, USA (hereinafter referred to as the “Organization”, “Leader”), who will be organizing and leading the retreat.
By signing this document, you waive certain legal rights, including the right to sue or claim compensation following an accident or unprecedented event.

ASSUMPTION OF RISK
The Participant understands and accepts that participating in the Retreat involves certain inherent risks and potential dangers. These risks may include, but are not limited to:

Travel-related Risks
Unforeseen incidents and accidents during travel, including vehicle accidents or falls.
The possibility of sustaining injuries during travel, recreational activities, or any other Retreat-related events.
The risk of illness due to factors such as climate, food, or local health conditions.
Unforeseen delays in transportation arrangements that may affect the Retreat schedule.

Service-related Risks
Injuries that may occur during Retreat activities or while using facilities.
The potential for dissatisfaction with the quality or delivery of services provided during the Retreat.

External Risks
Unpredictable natural events like earthquakes, floods, hurricanes, or extreme weather conditions.
Acts of violence, terrorism, or political instability that may occur in the Retreat location.
Political unrest, demonstrations, or civil disturbances that could impact safety.
Potential for public disorder or civil unrest in the Retreat destination.
The risk of personal attacks, theft, or harassment by third parties.
Other unforeseen events or circumstances that may pose risks to participants.

The Participant acknowledges that their participation in the Retreat is entirely voluntary, and they have made an informed decision to do so despite the known and potential risks mentioned above.

The Participant further acknowledges the importance of adhering to any safety guidelines, instructions, or precautions provided by the Leader or the Organization during the Retreat. These precautions are intended to minimize risks and enhance the safety of participants.

By signing this Contract, the Participant confirms their understanding of these risks and agrees to assume responsibility for their own safety and well-being during the Retreat.

WAIVER OF LIABILITY AND LEGAL CLAIMS
The Participant acknowledges and agrees that Mothers Moving Mountains, LLC (“MMM”), the Leader, and their representatives shall not be liable for any loss, injury, damage, or harm suffered by the Participant during the Retreat.
The Participant further agrees not to bring any legal claims, actions, or lawsuits against Mothers Moving Mountains, LLC (“MMM”), the Leader, or their representatives, for any injuries, damages, losses, or harm, whether arising from actions or omissions of Mothers Moving Mountains, LLC (“MMM”), the Leader, or any other third parties, occurring during or as a result of the Retreat.
This waiver of liability and prohibition on legal claims extends to all individuals, entities, and representatives associated with the Leader, including but not limited to employees, agents, contractors, and volunteers.

EMERGENCY PROCEDURES
In the event of an emergency during the Retreat, the Participant authorizes the Leader to take any necessary actions, including but not limited to seeking medical treatment on the Participant’s behalf, contacting the Participant’s emergency contacts, and cooperating with local authorities.

INSURANCE REQUIREMENTS
All participants are required to obtain comprehensive travel insurance that covers medical emergencies, trip cancellations, and interruptions, and personal belongings and baggage during the entire duration of the Retreat. This insurance should also include coverage for evacuation and repatriation in case of serious injury or illness.
The Participant further acknowledges that the Leader does not provide insurance coverage for participants.

LOCAL HEALTH AND SAFETY GUIDELINES
Participants are responsible for familiarizing themselves with and adhering to any local health and safety guidelines, laws, or regulations in the destination country. Failure to do so may result in the participant’s exclusion from certain activities or potential legal consequences.

EMERGENCY CONTACT INFORMATION
Participants must provide the Leader and the Organization with up-to-date emergency contact information, including the names and contact details of family members or friends who should be notified in case of an emergency.

PARTICIPANT’S RESPONSIBILITY FOR PERSONAL BELONGINGS
Participants are solely responsible for their personal belongings and valuables. Mothers Moving Mountains, LLC (“MMM”), the Leader, and the Organization are not responsible for any loss, theft, or damage to participants’ personal property during the Retreat.

MEDICAL CONDITIONS AND ALLERGIES
Participants must disclose any pre-existing medical conditions, allergies, or dietary restrictions to Mothers Moving Mountains, LLC (“MMM”) in advance of the Retreat. Mothers Moving Mountains, LLC (“MMM”), the Leader, and the Organization will make reasonable efforts to accommodate these needs, but participants acknowledge that certain accommodations may not be possible in all circumstances.
Participants understand and accept that in some cases, despite reasonable efforts, it may not be possible to fully accommodate certain medical conditions, allergies, or dietary restrictions during the Retreat. Participants acknowledge that they are solely responsible for managing their own medical conditions, allergies, or dietary restrictions and for taking any necessary precautions, including carrying appropriate medications or dietary supplements.
Participants further acknowledge and agree that Mothers Moving Mountains, LLC (“MMM”) shall not be held liable for any adverse reactions, illnesses, or medical conditions that may arise as a result of disclosed or undisclosed medical conditions, allergies, or dietary restrictions.

ACTIVITIES WITHOUT LOCAL GUIDING COMPANY
In cases where the Retreat involves activities without a local guiding company or outfitter, Participants understand and acknowledge that their participation in activities like, but not limited to, trekking through the wilderness, backpacking, biking, kayaking, food and beverage excursions, dancing, visits to the city, walking around, and engaging in various activities with locals may involve higher risks and responsibilities.
Participants understand that during such activities, they will be under the direct supervision and guidance of the Leader, and the Leader shall take reasonable measures to ensure the safety and well-being of participants.
Participants acknowledge and agree that the Leader shall not be liable for any loss, injury, damage, or harm suffered by the Participant during these activities even if they were following the Leader’s instructions.

FORCE MAJEURE
The Participant acknowledges that the Retreat may be affected by circumstances beyond the control of the Leader, such as natural disasters, acts of terrorism, political instability, or other force majeure events.
In the event of such circumstances, the Leader reserves the right to make necessary changes to the Retreat itinerary, including cancellation, without liability.

GOVERNING LAW AND JURISDICTION
This Contract shall be governed by and construed in accordance with the laws of Colorado, United States of America, and any disputes arising under or in connection with this Contract shall be subject to the exclusive jurisdiction of the courts of Colorado, United States of America.

ACKNOWLEDGMENT
The Participant has read and understands this Liability Waiver Contract and voluntarily agrees to its terms and conditions. The Participant acknowledges that they are solely responsible for their safety and well-being during the Retreat.
